Lawyer slams EFCC over alleged twisting of Bauchi High Court judgments
An Abuja based lawyer, Jibrin Sa’ad Jibrin has slammed the Economic and Financial Crimes Commission EFCC for allegedly twisting and distorting judgments of the Bauchi State High Courts through false information posted on its website.
The lawyer accused the anti-graft agency of making “erroneous, false and misleading” claims about recent judgments delivered by the court in a dispute.
The EFCC had in a report posted on its website, accused one Alhaji Hamza Koshe Akuyam of attempting to evade investigation in a contract financing agreement dispute being handled by its operatives.
The Commission also alleged that the said person also sought an order of general perpetual injunction to restrain it from carrying out its official functions.
However, unsatisfied with the allegations, the legal practitioner in a statement, took a swipe at the EFCC, accusing it of deliberately misinforming the general public on the dispute.
The lawyer drew the EFCC attention to the fact that the said Alhaji Akuyam had already honoured the commission’s invitation in September 2024 and was released on administrative bail which he has since been observing.
He said that a High Court of justice presided over by Justice Aliyu Baba Usman had in a judgment on July 30, 2025 in a suit with number BA/271/2024, affirmed the validity of the contract financing agreement which is at the center of the dispute.
Similarly, the lawyer said that another High Court in Bauchi presided over by Justice M.M. Abubakar had in an earlier judgment of December 19, 2024, ruled that the contract financing agreement was valid and enforceable.
He said the EFCC as a party in the court cases, fully represented by its own lawyer, ought to have known that the subject matter of the dispute had been legally and lawfully resolved by courts for the parties involved.
The lawyer claimed that critical details of the court judgments were omitted from the EFCC’s public statement posted on the commission’s official page on August 27.
He attached a copy of the court’s enrolled judgment order to his press statement to support his position that EFCC was a party to the suit that had settled the dispute.
Jibrin stated that the EFCC’s publication created a false impression that his clients, Alhaji Hamza Koshe Akuyam was attempting to evade investigation whereas he had appeared before EFCC and was granted administrative bail.
“The main question of law, determined in Justice Aliyu Baba Usman’s judgment is to the effect that the Contract Financing Agreement the subject of the suit is valid,” the statement said.
The lawyer also refuted the EFCC’s claim that his clients had sought a “perpetual injunction of a general nature” against the commission’s activities and challenged the EFCC to provide evidence of such a request.
“Discerning members of the public can therefore see through the deliberate falsehood, obfuscation of issues and outright misleading publication aimed at scoring no tangible result other than attracting cheap publicity,” he further said.
Jibrin urged the public to disregard the EFCC’s statement and instead be guided by the facts presented in the relevant court processes.
The lawyer also noted that the EFCC was not represented in court on the day the judgment was delivered, adding that it would have been well informed it was represented or updated itself with the words and letters of the two High Court judgments.
