IPOB: Court Admits Ex-AGF Malami’s Petition Linking Kanu To Terrorism

Justice James Omotosho of the Federal High Court, Abuja, has admitted as evidence a petition allegedly written by former Attorney General of the Federation, Abubakar Malami, accusing the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, of terrorism, inciting violence, and murder.

The petition, dated June 17, 2021 and addressed to the Department of State Services (DSS) was tendered by the prosecution as part of the ongoing trial of the IPOB leader.

Justice Omotosho marked the letter as Exhibit PWF after the defence team, led by Kanu Agabi, a Senior Advocate of Nigeria, raised no objections.

Earlier, the prosecuting counsel, Adegboyega Awomolo, a Senior Advocate of Nigeria, presented his witness a masked prosecution witness with code name BBB before the court to give his testimony, focusing on the petition.

According to the document, Kanu’s broadcasts allegedly incited attacks on security agencies, resulting in deaths and destruction of public infrastructure including police stations and correctional facilities.

“He instructed, through his broadcast, that police and army seen should be brought down and their guns seized,” the witness testified.

The court also admitted Kanu’s written statement to the DSS, dated July 17, 2021, in which he declined to offer further written testimony, saying he had already addressed the allegations. That document was marked as Exhibit PEG.

Further evidence, including a flash drive containing recordings of Kanu’s broadcasts, were admitted as Exhibits PWA and PW1 despite objections from the defence team.

In one of the videos Kanu was seen addressing followers from “the blessed land of Biafra,” announcing the formation of the Eastern Security Network (ESN) and urging resistance against “Fulani domination.”

He also allegedly warned governors in the South-East against making political compromises, vowing that “no Fulani parading as herdsman shall be allowed in our land.”
