ICJ Dismisses Sudan’s Genocide Case Against UAE
The International Court of Justice (ICJ) has dismissed a case brought by Sudan against the United Arab Emirates, accusing the Gulf nation of violating the Genocide Convention by supporting paramilitary forces in Sudan’s Darfur region.
In its ruling on Monday, the court held it lacked jurisdiction to impose provisional measures against the UAE, effectively ending the case.
Sudan had sought urgent intervention over what it described as “Emirati support” for genocidal acts in Darfur.
Reacting to the decision, Reem Ketait, UAE’s Deputy Assistant Minister for Political Affairs, described it as “a clear and decisive affirmation” that the allegations were unfounded.
“The Court’s finding that it is without jurisdiction confirms that this case should never have been brought,” she said.
“Today’s decision represents a resounding rejection of the Sudanese Armed Forces’ attempt to use the court to spread misinformation and deflect blame,” she added.
Ketait further stated that the UAE “bears no responsibility for the conflict in Sudan”, instead pointing to documented atrocities committed by the country’s warring factions.
Sudan filed the case in March, claiming the UAE was supplying arms to the Rapid Support Forces (RSF), a paramilitary group accused of committing widespread violence in Darfur. The UAE has consistently denied the accusations.
In court, Sudan’s acting Minister of Justice, Muawia Osman, alleged that a genocide was being carried out against the Masalit ethnic group in western Sudan, with direct support from the UAE.
The conflict, which erupted in April 2023, has pitted the Sudanese Armed Forces, led by General Abdel Fattah al-Burhan, against the RSF, headed by his former deputy, Mohamed Hamdan Dagalo.
The power struggle has plunged the country into a humanitarian disaster, with no diplomatic resolution in sight.
Both Sudan and the UAE are signatories to the 1948 Genocide Convention, which the ICJ is tasked with interpreting and enforcing in disputes between states.
