Osun LG Case: PDP Didn’t Win At Appeal Court, Says Adegoke

Senior Advocate of Nigeria, Kunle Adegoke, has dismissed claims that the Court of Appeal declared Peoples Democratic Party (PDP) chairmen and councillors as the valid occupants of local government offices in Osun State.

He insisted that such an interpretation misrepresents the ruling delivered on June 13, 2025.

Speaking on Arise News on Thursday, Adegoke explained that the leading judgment of the Court of Appeal remains the binding decision of the court, while any concurring opinions that contradict it cannot stand as law.

“The decision of the Court of Appeal on June 13 did not say anything of that nature. Any concurring opinion of a judge of the Court of Appeal or Supreme Court must align with the decision in the leading judgment.

“Where it goes against it, such a view is a no-beater and does not form part of the court’s decision,” he said.

According to him, Justice Peter Obiorah’s ruling, which some parties are citing, did not overturn the earlier judgment of February 10, 2025, that reinstated All Progressives Congress (APC) chairmen and councillors removed by Governor Ademola Adeleke’s administration.

He stressed that the Court of Appeal made it clear it could not revisit or sit on appeal over its own earlier judgment.

“What the court said is that re-listing the dismissed appeal would amount to sitting on its earlier judgment, which it cannot do.

“Nothing was said by Justice Obiorah or any of the panel members to the effect that the PDP councillors are the valid people in office or that the APC councillors have been sacked,” Adegoke stated.

He maintained that the ruling firmly upheld the APC’s victory, rejecting the PDP’s attempt to reopen the dismissed appeal.
