Plateau Gets NERC’s Approval As 10th State To Regulate Electricity

The Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of the electricity market in Plateau State to the Plateau State Electricity Regulatory Commission (PSERC).

With this development, Plateau becomes the 10th state in Nigeria to gain control over its intrastate electricity market.

Other states that have previously received NERC’s approval for intrastate electricity regulation include Lagos, Ogun, Oyo, Edo, Ondo, Ekiti, Kwara, Kaduna, and Akwa Ibom.

NERC in an Order posted on its Website on Friday, stated that the transfer follows the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023, which allows states to regulate their electricity markets within their borders.

According to the Order, NERC retains authority over inter-state and international generation, transmission, supply, trading, and system operations.

“The Electricity Act 2023 mandates that any state wishing to establish and regulate its intrastate electricity market must formally notify NERC and request the transfer of regulatory authority to the state regulator”, the commission stated.

It noted that the Plateau State government met the legal requirements and submitted its request, leading to the commission’s decision.

As part of the process, NERC has directed Jos Electricity Distribution Plc (JED) to incorporate a subsidiary, JED SubCo, which will take on the responsibility for intrastate electricity supply and distribution in Plateau State.

” JED has been given 60 days from March 12, 2025, to complete the incorporation of JED SubCo. The new subsidiary is expected to obtain the necessary licenses from PSERC to operate within the state.

“The entire process, including the transfer of regulatory oversight, must be finalized by September 12, 2025”, NERC stated.
