Family dispute: Court orders exhumation of corpse for proper burial in Kaduna
An Upper Customary Court in Kaduna has ordered that a corpse wrongly buried in Fadiya, Zangon Kataf LGA of Kaduna State be exhumed and given a proper burial in accordance with the tradition and custom of Bajju people.
A disagreement among the children of late Mrs Cecilia Peter Kabruk over her final resting place led to a protracted family dispute that kept the corpse of the deceased unburied for a long time.
The presiding judge of a Kaduna State upper customary court, Television Judicial Division, Douglas Danladi while delivering judgment explained that the corpse of late Mrs Cecilia that was wrongly buried be exhumed and handed over to the elders of the family for proper burial.
The magistrate also awarded the sum of N2.5 million for the purpose of unlocking the house at Fadiya, Zangon Kataf, for the exhumation of the corpse and filling the old grace.
Barr. James Bala Ndam, who represented the judgment creditors of Emmanuel Bakam Peter and Sama’ila Bakam, explained that they earlier won the case at the Upper Customary Court and Customary Court of Appeal against the other party comprising Hajiya Maryam Doka,
Maureen Kabruk, Dud Peter, George Peter and Pascalina Bakam.
Ndam explained that after two judgments, the other party appealed against the judgments. He said they also filed a counter affidavit before the Court of Appeal but before the hearing of the suit, the other party went ahead to violate the court orders and buried the late Mrs Cecilia Peter Kabruk.
He explained that he had prayed for an order committing the respondents to prison for violating the court orders as contained in the judgements delivered on the 19th September, 2024 and 6th February, 2025.
