Court nullifies Ekiti PDP LG congress, upholds ward executives
An Ekiti State High Court sitting in Ado-Ekiti has nullified the Peoples Democratic Party, PDP, local government congress held in May 2025, declaring it invalid.
In its ruling on Friday, the court upheld the ward congress earlier conducted on March 15, 2025, which produced new party executives across the state’s 177 wards.
Delivering judgement, Justice Bamidele Omotosho cited established legal principles, stressing that “no suit based on a charlatan claim must be acted upon by the court.”
Relying on unchallenged affidavits and evidence before it, the court made several pronouncements, including the recognition of the claimant as the duly elected chairman and delegate of Ward 1, Ado-Ekiti Local Government, as stipulated by the PDP’s 2024 guidelines for the conduct of conventions.
Justice Omotosho also declared the delegate list submitted by the defendants to various party organs as “invalid” for contravening sections of the Electoral Act 2022, the PDP Constitution (as amended), and the Nigerian Constitution. The court also issued a perpetual injunction restraining the defendants and their agents from recognizing or using the disputed list of delegates.
The judge warned all parties to respect the court’s orders, refrain from self-help, and avoid undermining the authority of the judiciary. Actions taken in violation of earlier restraining orders regarding the 177 ward congresses were described as contemptuous and consequently nullified.
Reacting to the judgement, PDP chieftain Funsho Ayeni welcomed the decision, describing it as a chance for party members to close ranks.
“This ruling provides an opportunity for reconciliation and unity. Leaders must work together to strengthen the PDP ahead of the June 20, 2026, governorship election and ensure victory over the APC,” Ayeni said.
